The Jurisprudence of the Enlightenment (18th Century)

Under this body of jurisprudence, our focal points are the Allgemeines Landrecht (ALR) of Prussia (1794) and the Austrian Allgemeines Bürgerliches Gesetzbuch (ABGB, 1811) as well as contemporary English case law and scholarship such as Blackstone’s Commentaries on the Laws of England. A key figure in this body of jurisprudence is Franz von Zeiller (1751–1828), the 'father' of the Austrian Civil Code who was heavily influenced by Kant's writings. All three team members contribute to this work.

Field Trips to Germany

In carrying out her research on this body of jurisprudence, Felicitas made field trips in 2024 to the Max Planck Institute for Legal History and Legal Theory in Frankfurt and the Berlin State Library. She has reflected on these experiences in this blogpost.

Franz von Zeiller

Through 2025, Felicitas has been writing up her research on Franz von Zeiller, sometimes known as the 'father' of the Austrian Civil Code and a legal scholar who was deeply interested in distinctions between the inner and outer. This work will appear in our forthcoming book, Law and the Inner Self.
